Conditions of Participation for the International Violin Competition Stuttgart of the Guadagnini Foundation
These Conditions of Participation apply to all
participants of the Stuttgart International Violin Competition of
the Guadagnini Foundation (hereinafter also referred to as the "Competition").
By participating in the Competition by sending the online registration
form, the participants declare their agreement with these Conditions of
Participation as well as with the Competition Terms referred to herein.
1. Organiser
The
organiser of the Stuttgart International Violin Competition is the
Guadagnini Foundation, Postfach 150502, 70077 Stuttgart (hereinafter "Guadagnini Foundation"). The Competition is held in cooperation with the State University of Music and the Performing Arts Stuttgart (Staatliche Hochschule für Musik und Darstellende Kunst - HMDK) (hereinafter "HMDK Stuttgart").
2. Entitlement to participation
Violinists
of all nationalities who are not older than 28 years of age at the date
of the registration deadline are entitled to participate. The decisive
date for this is the date of birth specified in the terms and conditions
for the respective Competition (hereinafter referred to as "Competition Terms"). Violinists whose teachers are on the jury of the International Violin Competition Stuttgart are excluded from entry.
3. Registration and conditions for participation (pre-selection)
Registration for the competition will take place exclusively online via the website www.muvac.com, Beginning on the date specified in the competition terms. The registration deadline will be the date specified in the competition terms. Late or incomplete registrations will not be accepted.
For online applications, participants must complete their muvac profiles with the following information:
- Personal data: enter your personal data and upload your profile photo.
- Resumé: under “CV / Resumé” enter your full curriculum vitae.
- Required documents: under “Documents” please upload the following:
1. “Portrait photo”: a high-resolution artist photo, free of any copyright (jpeg)
2. “ID or passport”: A scan of your passport or ID card
3. “Repertoire”: a document with the planned competition repertoire - Videos: please upload your application videos to YouTube or Vimeo
and add them to your muvac profile under “Videos”. For pre-selection we
require one video with all recordings or three separate videos
containing the following tracks:
1. Wolfgang Amadeus Mozart
First Movement and cadenza from one of the following concertos for violin and orchestra:
G major, KV 216
D major, KV 218
A major, KV 219
2. Niccolò Paganini
Two caprices from: 24 Caprices for Solo Violin, Op. 1
The selection of caprices from the preliminary round must not be repeated in the first round of the competition.
The music video must be produced without retouching the image and sound. This must be confirmed by the signature of the unit manager.
No registration fee is payable for participation in the Competition.
The costs incurred by the participant in connection with the Competition
shall be borne by the participant.
All applications received on time
and in full will be evaluated by the jury as part of the pre-selection
for the Competition. From this, 24 participants will be admitted to the
Competition.
All applicants will be notified by e-mail of their
admission to the Competition by the date specified in the Competition
Terms. Admitted participants must confirm their participation in the
Competition by e-mail to the Guadagnini Foundation by the deadline
specified in the Competition Terms.
4. Execution of the Competition
The
1st Stuttgart International Violin Competition of the Guadagnini
Foundation takes place on the days specified in the Competition Terms in
Stuttgart/Germany and is organised in cooperation with HMDK Stuttgart.
All
participants must register on the evening before the first
day of the Competition at the Competition Office in Stuttgart, stated in
the Competition Terms. The order of the performances of the
participants will be determined by the drawing of lots and announced on
this day.
The Competition consists of two preliminary rounds and the final round.
The two preliminary rounds will take place in the Chamber Music Hall (Konzertsaal)
of the HMDK Stuttgart with piano accompaniment. Each participant is
entitled to an official piano accompaniment free of charge, which will
be assigned to him together with the draw of the order of performance.
The participants may use another piano accompanist at their own expense.
The
jury will select 8 participants for the second preliminary round after
the first preliminary round of the Competition. These 8 participants
will compete in the second preliminary round, from which the jury will
select the 4 finalists who will then compete in the final round. The
jury's decision will be communicated to the participants at the end of
each preliminary round.
The final round will take place in the Beethovensaal Liederhalle Stuttgart. The four finalists will be accompanied by the
Stuttgart Philharmonic Orchestra during the final round. All Competition
rounds are open to the public and can also be followed online worldwide
via live stream.
5. Jury
The
pre-selection of candidates, admission to the second preliminary round
and the final round and the selection of winners will be carried out by a
jury appointed and selected by the Guadagnini Foundation, which will
make its decisions at its own discretion. Following the final round, the
jury will select the first three winners and the winner of the special
prize of the Competition. The decisions of the jury are final and
incontestable.
6. Prizes, final concert and award ceremony
The finalists of the Competition will receive a cash prize in
accordance with the prizes stated in the Competition Terms. The jury
will also award a special prize of the Competition.
It is not
possible to disburse prizes in cash, in kind, or to exchange or transfer
them to other persons. A participant may waive his or her prize, which
will then be forfeited for the benefit of the Guadagnini Foundation.
All
prize winners are obliged to participate in the final concert. The
winner of the Competition will perform in the final concert together
with the orchestra. The official award ceremony will take place at the
end of the final round.
7. Obligations of the participant, transfer and granting of rights of use and exploitation
By
submitting their artist photos and application videos, the participants
confirm that these are free of third-party rights (e.g. copyright,
trademark or competition rights of participating musicians) or that they
hold the rights required for the distribution or publication. By
registering for the Competition, the participants grant the Guadagnini
Foundation and its Competition partners the right to use and publish
free of charge the artist photos, application videos, name and
biographical information, in particular the musical career, submitted as
part of the application, in all online (e.g. website) and off-line
media (e.g. print) of the participant for the purposes of organising,
advertising and executing the Competition, as well as announcing the
results and winners of the Competition, or to pass them on to media
representatives for this purpose.
In addition, the participants agree
that all performances in the context of the Competition may be
broadcast live online worldwide and that photo, sound and video
recordings (hereinafter referred to as "Recordings") of
the participants may be made during the Competition. The Guadagnini
Foundation is entitled to use and exploit these Recordings for all
purposes permitted to the Guadagnini Foundation, in particular for
advertising and communication purposes, and/or to have them used and
exploited by third parties. This includes all current and future types
of media and usage (in particular audio-visual data carriers, online and
off-line media, television, radio, streaming, download). To the extent
permitted by law, the participants of the Guadagnini Foundation shall
transfer or grant free of charge to the Guadagnini Foundation all rights
to the Recordings arising from them, exclusively, irrevocably,
transferably, sublicensable, unlimited in time, place and content. There
is no right to a fee for the Recordings and further use. Statutory
claims remain unaffected.
8. Data protection
The
Guadagnini Foundation processes the personal data of the participants
collected in connection with the Competition (e.g. name, address, e-mail
address, telephone number, images and sound recordings) in accordance
with the applicable provisions of data protection law, in particular the
General Data Protection Regulation (GDPR) and the German Federal Data
Protection Act (Bundesdatenschutzgesetz, BDSG). If necessary
for the execution of the Competition, the data may also be passed on to
HDMK Stuttgart, the jury and other service providers commissioned by the
Guadagnini Foundation with the administration and execution of the
Competition.
By registering for the Competition, participants agree
that their personal data, as well as the Recordings produced and made
available in connection with the Competition for the press and public
relations work of the Guadagnini Foundation (in online and off-line
media) and its official Competition partners, as well as media
representatives, may be passed on for the purpose of reporting on the
Competition.
Any consent given may be revoked at any time in the
future bis-à-vis the Guadagnini Foundation, without affecting the
lawfulness of the processing carried out on the basis of the consent
until revocation.
Data processing is based on Article 6 (1) (b) GDPR
(performance of a contractual relationship), Article 6 (1) (a) GDPR
(consent) and Article 6 (1) (b) GDPR (overriding legitimate interests of
the controller). In addition, the Data Privacy Statement available on
the website of the Guadagnini Foundation shall apply.
9. Liability
The
Guadagnini Foundation shall be fully liable for intent and gross
negligence as well as for damages resulting from injury to life, body or
health.
In the event of slight negligence, the Guadagnini Foundation
shall only be liable for breaches of a material contractual obligation
(cardinal obligation). A cardinal obligation in this sense is an
obligation which makes the proper execution of the Competition possible
in the first place and on the fulfilment of which the participant
relies. In this case, however, the Guadagnini Foundation shall only be
liable for the foreseeable damage typical of the contract.
The
limitation of liability also applies, with the necessary modifications,
to the employees, contractors and vicarious agents of the Guadagnini
Foundation.
10. Early termination or abandonment of the Competition, exclusion from the Competition
The
Guadagnini Foundation is entitled to abandon, suspend or modify the
Competition prematurely in the event of unforeseen circumstances beyond
the control of the Guadagnini Foundation, which make the original
execution difficult or unreasonable for the Guadagnini Foundation.
The
Guadagnini Foundation reserves the right to exclude participants from
the Competition for important reasons, in particular if there is an
urgent suspicion or proof of false information, manipulation, violation
of these Conditions of Participation or other unlawful acts. The
Guadagnini Foundation is entitled to withdraw prizes awarded if
violations of the Conditions of Participation, in particular violations
of the provisions of Clause 10, Sentence 2, are proven.
11. Miscellaneous
Any
questions, comments or complaints regarding the Competition should be
addressed to the Guadagnini Foundation.There is no legal recourse with
regard to the decision on participation and the decision concerning the
prize winners. All other disputes shall be governed by the law of the
Federal Republic of Germany to the exclusion of private international
law provisions. If a participant does not have a general place of
jurisdiction in Germany, Stuttgart shall be agreed as the place of
jurisdiction, unless further formal requirements apply beyond the
agreement of these conditions with regard to the place of jurisdiction
agreement.
Should individual provisions of these Conditions of
Participation be invalid, or should there be a loophole, this shall not
affect the validity of the remaining provisions. The ineffective or
incomplete provision shall be replaced or supplemented by one that comes
closest to the interests of the Guadagnini Foundation and the
participants.
The Guadagnini Foundation reserves the right to adapt these Conditions of Participation,
in particular to changes in the legal environment or technical
conditions. The current version of these Conditions of Participation is
available online on the Guadagnini Foundation website. In case of doubt,
the German text of the Conditions of Participation shall prevail.
